Point still stands. It is abusable. You can't check if you did illegal trading to get rid of it and if that was fixed other techniques would be discovered.

Yes you can. Only Quest Items and apparently horses don't drop on death.

As long as there is no exchange merchant, my vote is no, as people would just abuse this to exchange items.

You seem to have more of an issue with losing valuable items to Wynn's system, and your presented solution is to change the no-refund policy to... What is your solution? To do away with the policy all together just so that mods can refund people for losing one specific type of item? What would stand in the way of people demanding new version of any item in the game? What are the parameters you suggest? I feel the usage of the phrase "Give them an inch and they take a mile" is appropriate here. Once people start getting refunded for hive items and the like, people will demand all sorts of items.

And this suffers the exact same fate as the Hive items you cherish. The exact same logic can be applied here, and it is the reason items will not be refunded at all.

While I do agree losing items to the game's mechanics is an issue that needs to be fixed as soon as possible, I do feel that the temporary solution you've offered here would be less beneficial in the long term (for the reasons I outlined in my first response), as opposed to just maintaining the no-refund policy.

and yes the phrase does apply, but if you can't check for items that aren't quest items, you can't implement something people want

They should do. By the way it's been talked about, Untradable items should be droppable on death and that's something that needs to be fixed.

And trading untradables is 100% a glitch and illegal and we will ban anyone who we find to be doing it.

Untradable items can't be picked up by any player except the owner.

I would say a sad no as it would probably be erased/deleted by Wynn. Mainly due to it considering showing how to do a bug. I doubt there is a way to show without showing the bug in use.
