1) @ThomAnn100 "gore" is an attack using horns, antlers, or tusks

2) @Paradoxical I agree, you should not be punished for simply seeing some weird animals and not attacking them. BUT... these ARE intelligent creatures (I think). Appearing passive so they don't get attacked, and then attacking without warning is a perfectly valid tactic.

The issue is that they (originally) managed to fly fast enough to get into range and attack Erevan, from the top of a mountain, while we could see them, without any of us being able to react. Here's what I would have done as the DM here:

 

Right. I just think calling a surprise round here is impossible, since they would have to dive several hundred feet within seconds, much faster than their speed allows for.

 

yeah, they were 100 metres away, which is 330 feet.
The fastest flying creature I've seen so far has a flying speed of 120 feet. So they couldn't have surprised us.

Now that they are closer, I'll use my action and throw my poisonous gas at the one next to Erevan.
It needs to make a Con save or take 8 poison damage and become poisoned until next round.
(I'm not sure if Erevan needs to take the save aswell. It's splash damage of 5 feet, and he might be close. I'll place a marker down where I threw it at (green cloud).)
