wouldn't the mod that closes the necro'd thread be the last commenter before locking it, therefore making it impossible to win?

The last comment that was made before the thread goes into necro range essentially. The comment that revives the thread after that threshold, or necroposts, does not count. This would include a mods post. However, if the mod commented before a week went by, then they would win. That however, would be unfair unless they had valid reasoning.

 

We could start a flame war to get this thread locked early if we wanted to
